A civil third party is a party to the dispute who is not related to the litigant by blood and who is willing to file a civil lawsuit alongside the litigant if an amicable resolution is not possible.
Clause 3, Article 3 of Decree No. 03/2021/ND-CP states that a person who sustains harm to their health, life, or property as a result of a motor vehicle is considered a third party, with the following exceptions:
a) The driver, or the person in charge of the vehicle. In contrast to the Civil Code, the concept of a third person is expanded to include the car owner's relatives (parents, spouse, children, and siblings).
A motor vehicle is a piece of machinery and equipment that is constantly in danger of malfunctioning due to technical, electrical, mechanical, or thermal factors, including brake failure, loss of control, fire, explosion, tire explosion, etc. This machinery and equipment travels on the road at a high rate of speed, so if a technical issue arises that cannot be resolved right away, it will either result in an accident involving another vehicle or the vehicle that is not experiencing technical issues may collide with another vehicle as a result of the driver's negligence. Because of this, the Civil Code (Article 623) declares that using a motor vehicle while driving puts one in grave danger. In the event that the law governing traffic order and safety is broken, owners who exploit extremely dangerous sources are required to pay for any damage these sources may have caused.
When an accident occurs, the driver and the victim are separated from their homes, places of employment, and loved ones because they are driving and cannot afford to cover the costs of the accident's aftermath. Therefore, in order to protect the victim's rights and interests when a traffic accident occurs, the vehicle owner must make restitution and the victim must be qualified for immediate medical attention. In order to cover their liability to the victim, the car owner must pay the advance costs of emergency care on behalf of the victim through the insurance company. To safeguard public interests and social safety, motor vehicle owners must carry mandatory civil liability insurance.
Participating in the Compulsory Civil Liability Insurance for motor vehicle owners and ensuring financial safety for the vehicle owner (paying a low annual fee to be ready to pay for accidents at any time) and ensure the rights of the victim (with compensation from the insurance company in case of an accident).
